All I see is that it makes safety regulations a little tougher, maybe. That could be good if it means Elio can market it as safer.

Exactly. Elio's original legislative take was to make the Elio accessible to a larger percentage of the population. They did that by establishing both the autocycle designation AND the helmet exclusions for enclosed cabs.

They never got the federal Autocycle legislation. What Elio did do is pave the way for other autocycles, current and future. That's good.
