While I still disagree with the fine and agree with an appeal, the fact that it was reduced to $38K is a huge victory of istself.

It is mid term election year and nobody want to be known as the person who killed off Elio and cost Shreveport 1500 jobs because of a massive fine on a frivolous suit. It's no different than the guy from the Caddo Parish that got Paul Elio down to Shreveport to give a talk. He knows that this will get him re elected as Elio will be hiring pretty soon then will be cranking the cars off the assembly line well before the 2020 primaries. When you get in bed with the politicians, you got to take the good with the bad. Now it's all good and they will all be more than welcoming Elio Motors.

Pay it-- an appeal will probably cost as much as the fine.

Paying means accepting guilt and the judgement standing. They have to appeal. If they feel like they will lose they appeal and then settle with another NDA signed.

IMO. A good lawyer would appeal. He would ask the Judge to dismiss, or find the case no contest, with a small fine.
Remind both parties there is more to gain in cooperation than litigation.
These government entities know, you can't squeeze blood from a turnip.
Knowing Elio cannot pay huge fines, and bringing these lawsuits anyway, only proves one thing.

It might help Elio to show the judge how much income tax was paid to employees in Louisiana for the past few years.
Then ask the questions: Exactly how did we manufacture anything without employees and what did we manufacture in Louisiana?
I also think the case should have been dismissed and an appeal is necessary.

Further reading of the fines, Elio will be fined $1000 a day until they show proof that the refundable deposits are in a safe place (bank) and not spent.
