There is nothing saying insiders can't trade on exclusive information that they have.
It's when they give that information to someone who's NOT a true insider that's the problem.

They are not legally allowed to trade on insider information, it is a criminal offense. They do it and try not to get caught, mostly fines few go to jail. Insiders have to report stock trades to the SEC within a couple of days of the trade.
