Thank you for your kind words. If I understand correctly, you think that my opinion that elio motors has taken money under false pretenses is either wrong or premature.

At some point, if/when the vehicle is actually offered for sale and a binding contract is signed, there should be clear specifications on that agreement. If those specs are not met at time of delivery, I think both of us agree that that would constitute a breach.

Projecting a little further, if, at the time the binding contract is offered, the then-current specs are different than the specs than were announced at the time the first non-refundable, non-binding agreement was signed, do you believe that at that point, there is a breach, or a mis-representation going back to the time of the reservation? I do not. If the vehicle makes it to the point of being offered for sale, either the reservationist accept the offer, or declines, and I'm good with that.

In my mind (a scary place, to be sure), either the problem exists now, because elio is aware that they have made, and are making false "promises", or it does not exist at all. If they really are doing the best they can, there is, or at least should be, no liability on their part. I believe any claim at the point the binding contract is offered and/or accepted would have to be based on elio's knowingly promising that the would not meet that promise. In my mind, that could/would apply, whether the discrepancy was price, performance, standard equipment of whatever. On a realistic basis, I don't think anyone would sue over $1-2K on the price, or 5-10mpg, but I could be wrong.

I apologize if that does not clearly express my thinking.

Advertising is only false and misleading if it's knowingly incorrect. I don't think that's the case here, and certainly EM is close enough to targets that few will have more than moderate heartburn over the shortfalls. But I certainly do think they need to make darn sure their advertising and their performance really do match up ASAP, or else decide to modify the targets to square with reality. If they did that and THEN were able to hit better numbers, they'd look like absolute heroes -- both for truth-telling and for exceptional performance.

Under promise and over perform wins the most points.

excellent points with which I agree .... in thinking back to one of your recent post where you mentioned Paul being rather stubborn (for lack of a better term) about his "must haves," how do you see it playing out

In an interview he said 81mpg was great but 84 is the target and they are working to hit it. I can easily see them acquiescing to 80-81mpg

I believe they already have .... if you look on the EM website under the "Must Have" heading it says :

Must-have 1: Amazing MPG
While other vehicles make their competitive claims within a few MPGs of one another, we needed Elio to take it to the stratosphere. As we continue to engineer the Elio for up to 84 MPG, we officially have liftoff.

I can live with 80mpg. plus i know with A/C off and hypermiling i can blow past 84mpg

Note: According to Paul Elio if EM happens to qualify for CAFE credits, they could break even on the $6800 and still profit $600 million a year from selling credits alone plus all the Caddo Parrish profit incentives that will run through the year 2026 once they start hiring.

They shouldn't have changed their original must have target numbers and Elio may have done just that, under promise, over perform, and looked like heroes. Maybe they still will if the engine starts.
