Not sure what a lower court sorting out a collision has to do with anything. Whatever the legislation says is what it says. Whatever a judge does or doesn't like about it is irrelevant. Courts don't make law, (in theory). But if the law says three wheels doth a cycle make, then it's a cycle. Period. But if the legislators change that law in anticipation of lots of Elios run ng about the country, (cause they wanna cash in), then viola! It's a car!
Courts make law all of the time. They just change the way the read a law and infect change it. Happens a lot now days. What the Supreme Court this year you will see a lot of it.
